Tiffany Optica

The settlement concludes the lawsuit that Tiffany jewellery’s filed against Optica Haperin in April 2008. The parties asked the court to cancel the lawsuit, with no court costs. Judge Eitan Orenstin approved the settlement and gave legal standing.Tiffany’s sued Optica Halperin for importing, marketing, and advertising sunglasses prominently bearing the Tiffany’s trademark, even though the company did not make them. In its statement of defense, Optica Halperin said that it had purchased the goods in question in 1997-2001 from an Italian manufacturer, who held a trademark for the Tiffany jewellery’s logo. Optica Halperin said that it bought the goods in good faith, relying on the manufacturer’s right to make Tiffany products. Optica Halperin said that, in 2004, the claimant purchased from the Italian manufacturer the rights to the trademark, in other words, years after the purchase of the products that are the subject of the claim by Optica Halperin.
